The importance of making a Will can never be understated. A Will is one of the most important legal documents you can put in place in order to protect your family and to ensure that your property will be passed on to your chosen beneficiaries. It allows you to carry out Inheritance Tax planning. Having a Will ensures that the practicalities of dealing with your estate can be more easily dealt with.
In the absence of a Will your estate will be distributed in accordance with the Scottish Law of Intestacy which may not be as you intend. It will entail additional formalities and expense.
It should also be noted that if you marry or divorce, under Scots Law, your existing Will remains valid. It is, therefore, important to update your Will if your circumstances change.
